Terms and conditions of sale and use

 

1. Scope

These conditions regulate access to winabrand.com and purchases made in the Winabrand online store. The seller is COMPAÑÍA BALLENITA 98, S.L., NIF B81983686, with the complete data indicated in the Legal Notice. By placing an order, you agree to the version of these conditions available before payment. No clause excludes or limits mandatory rights of the consumer.

2. Capacity and accounts

To purchase you must have sufficient legal capacity or act with the authorization of your legal representative. The client is responsible for providing accurate and up-to-date information and for keeping his/her credentials secure. The customer account is optional when the store allows purchasing as a guest.

3. Product information

Winabrand strives to describe products accurately. Images may have slight color differences due to display or photography. The composition, size, compatibility, instructions, warnings, economic representative in the EU and other safety information shown on the sheet are part of the pre-contractual information. Third party brands belong to their owners.

4. Prices, taxes and promotions

Total price, taxes, shipping and any other required charges are displayed before you place your order. Obvious technical or pricing errors may be corrected before accepting the purchase; If an order that cannot legitimately be fulfilled has been charged at the wrong price, it will be refunded without delay. Promotional codes are subject to their conditions. Price reductions will be announced using as a reference the previous price required by regulations, including, where applicable, the lowest price applied during the previous 30 days.

5. Order and contract formation

The products displayed constitute an invitation to place an order and are subject to availability. Upon receipt, we will send an electronic acknowledgment of receipt. Unless a mandatory rule provides otherwise, the contract is accepted when we expressly confirm the purchase or ship the product. We may reject or cancel an order due to lack of availability, payment failure, reasonable suspicion of fraud, legal restriction or manifest error, fully refunding the amounts charged for canceled items.

6. Payment

Available payment methods are displayed on the checkout page and may be provided by regulated providers. By confirming the order, you authorize the payment of the total amount shown. Payments are automatically captured upon completion of the purchase. We will not add optional paid services through previously marked boxes.

7. Delivery

Destinations, rates and deadlines are regulated by the Shipping Policy and by the information shown before purchase. Products may arrive in separate packages. Winabrand remains responsible towards the customer for contractual obligations even if a supplier, warehouse or carrier intervenes in the preparation or delivery.

8. Cancellation, withdrawal and return

The 14-day right of withdrawal, exceptions, return costs and refunds are regulated in the Returns and Refunds Policy, which is part of these conditions. Disabling automatic refunds in the customer's account does not limit any legal rights: requests are processed through support@winabrand.com.

9. Legal guarantee

The products must comply with the contract. When there is a lack of conformity, the consumer will have the right to repair, replacement, price reduction or resolution/refund that corresponds to the law. The remedies required by the regulations will be provided free of charge. Any commercial guarantee will be additional and will not replace the legal guarantee.

10. Permitted use of the site

It is not permitted to use the site in a fraudulent or illicit manner, interfere with its security, introduce malicious code, attempt unauthorized access, extract or massively copy content without authorization or violate intellectual property rights or third parties. We may restrict abusive access to protect the store and its users, in compliance with the law.

11. Intellectual property

The Winabrand name, its logos, the site design and the original content are the property of COMPAÑÍA BALLENITA 98, S.L. or are used under license. You are granted only a limited, revocable, non-transferable authorization to access the site and make personal and lawful purchases. No ownership rights are transferred.

12. Third Party Services and Links

The store uses Shopify and can integrate payment, analytics, communication, suppliers, logistics and delivery services. When they act independently, their operation may be subject to their own conditions or notices. External links do not imply endorsement. Winabrand maintains the responsibilities that consumer legislation imposes on the seller.

13. Responsibility

Nothing in these conditions excludes liability for fraud, fraud, death or injury caused by negligence, defective or unsafe products, failure to comply with mandatory consumer standards or any liability that cannot legally be excluded. To the extent permitted by law, we are not liable for losses that were not reasonably foreseeable at the conclusion of the contract or for business losses of those who are not acting as consumers.

14. Privacy and cookies

Personal data is processed in accordance with the Privacy Policy and applicable regulations. Non-essential cookies and technologies are used only in accordance with the consent options provided in the banner and in the preferences center.

15. Modifications

We may update these conditions for future operations for legal, technical or operational reasons. The version made available to the client before placing it will be applied to each order. No change will retroactively reduce rights already acquired.

16. Applicable law and dispute resolution

Spanish legislation is applied without depriving the consumer of the mandatory protection of their habitual residence. The competent courts are determined in accordance with mandatory norms; No clause obliges the consumer to litigate exclusively in Toledo.
